Wie kaum eine andere Materie in Deutschland ist der Verwaltungsrechtsschutz verfassungsrechtlich geprägt. In einer Rechtsordnung, in der das Diktum Fritz Werners vom Verwaltungsrecht als konkretisiertem Verfassungsrecht im Grundsatz nach wie vor gilt und als rechtsstaatlich-zivilisatorische Errungenschaft empfunden wird, muss dies für den Verwaltungsrechtsschutz – den gerichtlichen Rechtsschutz in Ansehung der öffentlichen Verwaltung – erst recht gelten. Das ist nicht nur das Produkt einer mehr oder weniger weit ausgreifenden Verfassungsexegese, sondern ein vielfältig abgesichertes Verfassungsgebot.

This study aims to examine the development of diversity and inclusion (D&I) literature and identify its prominent themes and blind spots. The research was conducted using bibliometric analysis on the Web of Science database and included 2510 publications. Results showed that the development of D&I literature had increased exponentially since the 1960s, mainly due to different political and societal events. The geographic development showed that research was primarily conducted in developed countries where quotas and other legislation are implemented. The thematic (...) development revealed a stable but narrow focus on diversity management, board diversity, and team diversity, with little attention to inclusion. The keyword analysis strongly emphasized surface-level diversity, such as gender, race, and cultural diversity, while deep-level diversity received less attention. This study concludes that previous D&I literature has mainly focused on the financial effects of D&I and neglected other elements, such as the effects on social performance, its ethical implications, and the relationship between diversity and inclusion. The study recommends future research to expand the interpretation of diversity, examine the relationship between diversity and inclusion, and explore the effects of diversity on non-financial outcomes such as social performance and ethics. This study provides a valuable contribution to the field of business ethics by highlighting the blind spots in D&I literature and encouraging future research to consider the ethical implications of diversity in the workplace. In a series of case studies, it illuminates the developments in this region, most notably in Austria and Poland, examining thinkers such as Bolzano, Brentano, Meinong, Husserl, Twardowski, Lesniewski, and Tarski, as well as the logicians like Frege and Russell with whom they bore a close resemblance. For most of the history of metaphysics, the subject has been dominated by the concept of substance. There is an everyday commonsense notion of substance which is perfectly harmless and which I shall defend against attempts to remove it or revise it away. But I deny that substance has to be construed as a primitive even in everyday terms. Borrowing Strawson’s distinction between descriptive and revisionary metaphysics, I press the legitimate claims of revisionary metaphysics and argue that there is no (...) place for a fundamental concept of substance within it, although aspects of the concept are likely to find their place therein. A way of reading the Tractatus has been proposed which, according to its advocates, is importantly novel and essentially distinct from anything to be found in the work of such previously influential students of the book as Anscombe, Stenius, Hacker or Pears. The point of difference is differently described, but the currently most used description seems to be Goldfarb’s term ‘resolution’ – hence one speaks of ‘the resolute reading’. I’ll shortly ask what resolution is. For now, it is enough that (...) it aims to give full weight to the penultimate section of the Tractatus in which Wittgenstein declares his propositions to be nonsense, where giving full weight to that declaration involves not hearing it as allowing that those ‘nonsensical’ propositions might have another kind of ‘sense’. In that same section Wittgenstein explains that these nonsense propositions, while devoid of meaning, have a use: to make the kind of use of them that their author intends – and so to understand him – requires recognizing that they are nonsense; and through that recognition one ‘surmounts’ these propositions, and is led ‘to see the world aright’. Frege's theory of real numbers has undeservedly received almost no attention, in part because what we have is only a fragment. Yet his theory is interesting for the light it throws on logicism, and it is quite different from standard modern approaches. Frege polemicizes vigorously against his contemporaries, sketches the main features of his own radical alternative, and begins the formal development. This paper summarizes and expounds what he has to say, and goes on to reconstruct the most important steps (...) which he is likely to have subsequently taken. The various difficulties facing his theory in this reconstruction are outlined, and some surprising consequences drawn about the nature of his logicism. (shrink)

The relationship of part to whole is one of the most fundamental there is, yet until now there has been no full-length study of this concept. This book shows that mereology, the formal theory of part and whole, is essential to ontology. Peter Simons surveys and criticizes previous theories, especially the standard extensional view, and proposes a more adequate account which encompasses both temporal and modal considerations in detail. This has far-reaching consequences for our understanding of such classical philosophical (...) concepts as identity, individual, class, substance and accident, matter, form, essence, dependence, and integral whole. It also enables the author to offer new solutions to long-standing problems surrounding these concepts, such as the Ship of Theseus Problem and the issue of mereological essentialism. The author shows by his use of formal techniques that classical philosophical problems are amenable to rigorous treatment, and the book represents a synthesis of issues and methods from the analytical tradition and from the older continental realist tradition of Brentano and the early Husserl. This paper assesses those features of Lesniewski's Ontology which make it difficult to understand for logicians accustomed to more orthodox systems of logic. It is seen that certain general features of presentation and content can, by selective acceptance or modification, be accommodated with a fairly orthodox viewpoint. The chief difficulty lies in the interpretation of Le?niewski's names, and the constant ???. Four interpretations are suggested in turn: Le?niewski's names as monadic predicates; as class terms; as common nouns; and as empty, (...) singular or plural terms. This last and least orthodox interpretation is argued to be the most suitable, but it is shown how it can be made to live in harmony with either the common noun or the class interpretation. (shrink)

This paper continues a discussion that Adrian Moore and I have had about the place of idealism in Wittgenstein’s philosophy. While there are several unresolved issues in that discussion I want here to pursue only one; and, to minimize the risk of repetition, I will shift the primary focus of discussion from Wittgenstein’s earlier to his later thought. I will, though, have to say something first to identify the point I have in mind from the earlier discussion, and second to (...) indicate how the later issue corresponds to it. […] Moore and I share a view of Wittgenstein’s work as belonging to the Kantian, transcendental tradition; we are in agreement that the central requirement for a proper understanding of his thought is to make plain how it relates to the core ideas of that tradition, and in particular to transcendental idealism. But on just that issue we have disagreed. Suppressing niceties, and settling for what Adrian himself has called a “cartoon sketch,” Moore has held that in his early work Wittgenstein embraces transcendental idealism, while his later thought offers us ways of resisting it; whereas I have held exactly the reverse. Shepard promotes the important view that evolution constructs cognitive mechanisms that work with internalized aspects of the structure of their environment. But what can this internalization mean? We contrast three views: Shepard's mirrors reflecting the world, Brunswik's lens inferring the world, and Simon 's scissors exploiting the world. In this paper I propose a series of hypotheses for further study that are related to potential negative impacts of non-traditional export agriculture (NTEA) on peasantfarmers in Central America. International lenders and donor agencies are promoting this diversification of agricultural exports as part of structural adjustment programs in the region, in order to increase foreign exchange earnings and raise the incomes of the rural poor.There is growing evidence, however, that the impact on the rural poor may not be favorable. I (...) argue that because NTEA can introduce powerful economies of scale, it is likely to accelerate social differentiation in the countryside and expel large numbers of peasant farmers from their lands. In this sense NTEA may be similar to previous export ‘booms,’ leading to rapid intensification of social instability and conflict in an already troubled region. This raises the serious question of the long term sustainability of this development strategy.There is a shortage of published studies that directly address these issues, making further work essential for the adequate review of NTEA policies. I formulate six testable hypotheses based on the economies of scale associated with NTEA. Each is related to a resource essential for successful agricultural production: land; credit; prices, costs, and subsidies; technology; technical assistance; and markets. I suggest that as NTEA grows, small farmer access to each is reduced, eventually making peasant production for domestic consumption an unviable alternative, while those who venture into NTEA encounter unacceptable levels of risk. This article considers the Gibbs paradox and its implications for three definitions of entropy in statistical mechanics: the “classical” Boltzmann entropy ; the modified Boltzmann entropy that is usually proposed in response to the paradox ; and a generalized version of the latter. It is argued that notwithstanding a recent suggestion to the contrary, the paradox does imply that SB1 is not a satisfactory definition of entropy; SB2 is undermined by “second-order” versions of the paradox; and SB2G solves the paradox (...) but is not a satisfactory definition of entropy. The intertwining careers of William Torrey Harris converge in twelve of the Annual Reports of the Board of Directors for St. Louis Public Schools. Harris formulated most of the essential features of these twelve reports as the Superintendent of Schools from 1867 to 1869. These particular reports—which have been acclaimed nationally and internationally—are said to be among the most valuable official publications in American educational literature. They are far different from the descriptive documents originally intended by their author. This study (...) demonstrates that Harris provided an authentic philosophy of education, a set of interrelated philosophical principles and their applications to educational problems. The substance of Harris's philosophy of education is focused upon a broadly based philosophical anthropology in relationship primarily to the purposes, curriculum, and teaching methods in intellectual, moral, and religious education. There are at least three things we might mean by "ethics in robotics": the ethical systems built into robots, the ethics of people who design and use robots, and the ethics of how people treat robots. This paper argues that the best approach to robot ethics is one which addresses all three of these, and to do this it ought to consider robots as socio-technical systems. By so doing, it is possible to think of a continuum of agency that lies (...) between amoral and fully autonomous moral agents. Thus, robots might move gradually along this continuum as they acquire greater capabilities and ethical sophistication. It also argues that many of the issues regarding the distribution of responsibility in complex socio-technical systems might best be addressed by looking to legal theory, rather than moral theory. This is because our overarching interest in robot ethics ought to be the practical one of preventing robots from doing harm, as well as preventing humans from unjustly avoiding responsibility for their actions. Summary The development of post-war German social sciences is marked by a series of disputes about the nature and implications of positivist methodology. Two of these are selected for consideration here; the ‘positivist dispute’ in German sociology associated with Adorno and Popper, and the more diffuse assault on positivism in the legal sciences. In both cases, self-avowed positivists were in fact hard to find but the debates were important polemical disputes about the past—notably the Weimar Republic and the Third Reich—and (...) the future of the young Federal Republic. It is suggested below that these disputes should be seen in this context and that the polemical claim in both disputes that certain methodological standpoints mandated specific moral and political commitments is more questionable. Atran conjectures that a triggering algorithm for a living- kind module could involve inputs from other modules that detect animacy and intentionality. Here we further speculate about how algorithms for detecting specific intentions could be used to trigger between- or within-species categorization. Such categorization may be adaptively important in Eldredge's energy and information realms.

Drawing on Ciceronian rhetorical tropes, Thomas Aquinas treats the rite of the Eucharist in terms of the classical ars memoriae. The Eucharist, for Aquinas, is the schooling in desire whereby we are trained to order the associations of our memory to their proper objects in terms of their relations to God. He thus conceives of the liturgy of the Mass as rhetoric proper, which truly teaches, moves and delights. Since memory is the condition of all thought, as both Thomas and (...) Augustine claim, the Eucharist is the “site” of all theological production, and therefore the liturgy is the art of memory of which all other similar arts are derivative. (shrink)

Should weak forms of the axiom of choice really be accepted within constructive mathematics? A critical view of the Brouwer-Heyting-Kolmogorov interpretation, accompanied by the intention to include nondeterministic algorithms, leads us to subscribe to Richman's appeal for dropping countable choice. As an alternative interpretation of intuitionistic logic, we propose to renew dialogue semantics.
